Delaware apostilles come from the Division of Corporations in Dover, and most of what passes through it is company paperwork. A Delaware LLC or corporation opening a bank account, registering a branch, or signing a contract abroad will usually need its formation documents or a good standing certificate apostilled.

One rule trips up corporate orders more than any other: every filed document must be certified on its own. A bundle certified under a single cover certification cannot be apostilled, so order the certified copies separately from the start.

Delaware-specific things worth knowing

  • Certify each filed document separately. A one-cover certification of several filings is refused for apostille.
  • Good standing certificates go stale. Many foreign banks and registries want one issued within the last few weeks, so we order it close to filing.
  • Individuals pay less. Delaware caps the fee for a person requesting apostilles for their own non-commercial use, such as an adoption or custody case.
  • The notary must be commissioned in Delaware. A document notarized across a state line goes to that state instead.
  • Federal documents never go to DE Division of Corporations. An FBI background check, IRS letter or naturalization certificate is apostilled by the U.S. Department of State. See federal apostille.
